Chapter 1 General Provisions

Article 1 (Purpose)
These terms and conditions are intended to define the conditions and procedures for the use of all services provided by KyungSung MT Co., Ltd. (https://www.kyungsungmt.com), as well as other necessary matters.
Article 2 (Definition of Terms)

The definitions of terms used in these Terms and Conditions are as follows:

  • Member: An individual who has entered the required information, entered into a service use agreement with the Company, and received a user ID.
  • ID: A combination of letters and numbers selected by the member and approved by the Company for identification and service use.
  • Password: A combination of letters and numbers selected by the member to protect personal information during communication.
  • Termination: Termination of the service use agreement by either the Company or the member.
Article 3 (Announcement, Effect, and Amendment of Terms)
  • These terms are posted on the sign-up page and announced. The Company may amend these terms due to changes in circumstances or for important business reasons, and such amendments will be announced via the notices section.
  • These terms and any future amendments due to Company circumstances shall become effective upon being announced to users.
Article 4 (Matters Not Specified in These Terms)

Matters not specified in these terms and conditions shall be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization, the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Basic Act on Electronic Transactions, the Electronic Signature Act, the Consumer Protection Act, and other relevant laws.

Chapter 2 Service Use Agreement

Article 5 (Application for Use)
  • An applicant may apply for membership by agreeing to these Terms and the Privacy Policy, completing the registration process (submitting the Company’s prescribed application form), and clicking the ‘Confirm’ button.
  • Applicants must use their real name and accurate personal information, and may submit only one application per unique date of birth.
  • Users who do not enter their real name or accurate information are not legally protected and may be restricted from using the service.
Article 6 (Acceptance of Application)
  • The Company shall approve service use applications under Article 5, except in cases falling under paragraphs 2 or 3.
  • The Company may withhold approval in the following cases until the reasons for the restriction are resolved:

    • a. If there is not enough capacity in the service facilities
    • b. When there are technical difficulties
    • c. When deemed necessary due to Company circumstances
  • The Company may reject the application in the following cases:

    • a. If the application is submitted using another person’s name
    • b. If the information is falsified
    • c. If the application is made for purposes that disturb public order or violate public morals
    • d. If other application requirements set by the Company are not met

Chapter 3 Obligations of the Contracting Parties

Article 7 (Obligations of the Company)
  • The Company is obligated to operate the site in a stable and continuous manner.
  • If the Company deems any opinion or complaint from users as legitimate, it must handle it promptly. If immediate handling is difficult, the Company must notify the user of the reason and schedule via notice or email.
  • Exceptions apply when requested by investigative agencies, the Information and Communication Ethics Committee, upon presentation of a warrant, or as otherwise required by law.
Article 8 (Obligations of the User)
  • Users must read and comply with these Terms, notices, and guidelines, and must not interfere with the Company’s operations.
  • Users may not use the site for profit-making activities without prior approval from the Company.
  • Users may not copy, reproduce, alter, translate, publish, broadcast, or otherwise use information from the site without prior approval, nor provide it to third parties.

Chapter 4 Provision and Use of Services

Article 9 (Use of Services)
  • Users shall use the site in accordance with the provisions of these Terms.
  • Matters not specified in these Terms shall be governed by announcements posted by the Company or by separate notices.
Article 10 (Provision of Information)

The Company may provide various information to members via email or postal mail if it deems it necessary during service use.

Article 11 (Advertisement Posting)
  • The Company may post advertisements on service pages, websites, or via email in relation to service operation.
  • The Company shall not be liable for any losses or damages incurred as a result of members participating in, communicating with, or conducting transactions with advertisers featured on the site.
Article 12 (Restrictions on Service Use)

The Company may restrict service use if a user engages in any of the following acts:

  • If public order, morals, or other aspects of social order are violated.
  • If intending to commit or engaging in criminal activities.
  • If damaging others’ reputations or interfering with their service use
  • If repeatedly sending unsolicited or promotional messages against the recipient’s will.
  • If hacking, distributing viruses, or otherwise disrupting the operation of the service.
  • If infringing or potentially infringing upon others' intellectual property rights.
  • If using another person’s ID or password
  • If violating applicable laws or engaging in any conduct deemed inappropriate by the Company.
Article 13 (Suspension of Service)

The Company may suspend all or part of the service under the following circumstances:

  • If common carriers or internet network providers suspend services.
  • In the event of a power outage
  • If unavoidable due to relocation, maintenance, or construction of facilities.
  • If service is disrupted or experiencing excessive traffic, making normal operation difficult.
  • In the event or potential occurrence of war, incident, natural disaster, or national emergency.
Article 14 (Management of Posts)

To ensure healthy communication and site operation, the Company may delete, move, or reject posts that violate Article 12.

Article 15 (Responsibility for Service Use)

Users may not sell illegal goods or engage in commercial activities using the service without the Company’s express written consent. Users shall bear full responsibility for any consequences arising from violations.

Chapter 5 Ordering and Payment of Goods

Article 16 (Payment Method)

Members may pay for goods using various methods including prepaid cards, debit cards, and credit cards.

  • The Company shall notify the user with an order confirmation upon receiving the purchase request.
  • Upon receiving the confirmation, if the user identifies any discrepancies, they may immediately request changes or cancellations. If payment has already been made, the return policy in Article 18 shall apply.
Article 17 (Delivery Policy)
  • Unless otherwise agreed, the Company shall deliver goods within 7 days of payment.
  • The Company shall specify the delivery method, cost, and period, and compensate for any delay beyond the agreed period, unless it proves that there was no intentional or negligent fault.
Article 18 (Cancellation, Return, and Refund Policy)

If goods are out of stock, the Company notifies the user and refunds within 3 business days.

  • If cancellation occurs before shipment, the credit card authorization shall also be canceled accordingly.
  • Cancellation after shipping is not allowed; however, in case of issues caused by the Company’s fault, returns, refunds, or exchanges will be processed.

Chapter 6 Miscellaneous

Article 19 (Disclaimer and Damages)
  • The Company shall not be held liable for service interruptions caused by force majeure such as natural disasters.
  • The Company is not responsible for issues arising between members or with third parties.
  • Members are responsible for damages caused by negligence in managing their ID or password.
  • Users shall compensate for damages resulting from breach of these Terms.
Article 20 (Consent for Personal Credit Information Use)

The Company must obtain user consent prior to providing or using personal credit information with third parties, and such consent shall be deemed to include consent for use by public institutions and credit information agencies.

Article 21 (Dispute Resolution)
  • Users and the Company shall make every effort to resolve disputes amicably.
  • Notwithstanding the foregoing, if a lawsuit is filed, the court with jurisdiction over the location of the Company's headquarters shall have exclusive jurisdiction.
Addendum

These Terms and Conditions shall take effect from 2018.
